TERMS AND CONDITIONS OF SALE
The products made available on this site are for strictly personal use. In the case of ordering products intended for resale, HEDONIST LABS reserves the right to refuse the order. For distributors and pharmacies, please send us an email at email@example.com
Orders are prepared by our teams at our premises.
Each product is shipped with a seal. This is a security device ensuring the inviolability of the bottle. If the seal is not present, you should not accept your package. Your order will then be subject to return, and we will claim compensation from the carrier. You will be refunded upon receipt of the package.
These terms of sale apply, without restriction or reservation, to all sales concluded between, on the one hand, the company HEDONIST LABS, a simplified joint-stock company, registered with the Paris Trade and Companies Register under number 884 875 295, whose registered office is 10 Rue de la Paix 75002 PARIS, whose intra-community VAT number is FR2884875295, trading under the name HEDONIST LABS (hereinafter referred to as "HEDONIST LABS"), and on the other hand, any non-professional buyer (hereinafter referred to as the "Client" or "Clients") wishing to purchase the products offered for sale by HEDONIST LABS (hereinafter referred to as the "Products") via the Internet site (hereinafter referred to as the "Website"). They specify in particular the conditions of order, payment, delivery, and the management of any returns of the Products ordered by the Clients. The Products offered for sale on the Website are dietary supplements, plant extracts, cosmetic products, and skincare products. The main characteristics of the Products, in particular the specifications, illustrations, and indications of dimensions or capacity of the Products, are presented on the Website. The Client is obliged to take note of them before placing any order. The choice and purchase of a Product are the sole responsibility of the Client.
The photographs and graphics presented on the Website are not contractual and cannot engage the responsibility of HEDONIST LABS.
The Client is required to refer to the description of each Product to know its essential properties and characteristics.

Validation of the order by the Client constitutes acceptance without restriction or reservation by the Client of these terms of sale. The Client acknowledges having the required capacity to contract and acquire the Products offered on the Website. These terms of sale will prevail over any other general or specific conditions not expressly agreed by HEDONIST LABS. These general conditions of sale are accessible at any time on the Website. The Client declares that he has read these general conditions of sale and accepted them by ticking the box provided for this purpose before implementing the online ordering procedure as well as the general conditions of use of the Website.
HEDONIST LABS reserves the right to modify its terms of sale at any time. In this case, the applicable conditions will be those in force on the date of the order placed by the Client. Unless proven otherwise, the data recorded in the computer system of HEDONIST LABS constitutes proof of all transactions concluded with the Client. The general conditions of sale are concluded for the duration necessary for the supply of the Products. In accordance with the Data Protection Act of January 6, 1978, the Client has the right to access, rectify, and oppose all of his personal data at any time by writing, by post, and by justifying his identity, to the above-mentioned address.
The Client can place an order online on the website
The Client who wishes to place an order on the Website must order according to the following modalities:
- create a "customer account" in which he will enter all the requested information.
- create an online "cart" by selecting all the chosen Products.
- accept these general terms of sale, validate his order after checking it.
- make the payment under the conditions provided.
Any order implies the Client's acceptance without restriction or reservation of these general terms of sale. Any order is deemed to be acceptance of the prices and description of the Products available for sale.
The contractual information is presented in French and is subject to confirmation no later than at the time of validation of the order by the Client.
From the moment the Client validates his order, he is deemed to have accepted knowingly and without reservation these general terms of sale, the prices, volumes, and quantities of products offered for sale and ordered. The sale will only be considered final after HEDONIST LABS has sent the Client confirmation of the acceptance of the order by email and after HEDONIST LABS has received full payment. It is the Client's responsibility to check the accuracy of the order and to report any errors immediately. Any order placed on the Website constitutes the formation of a contract concluded at a distance between the Client and HEDONIST LABS.
HEDONIST LABS's Product offers are valid within the limits of available stocks. When an ordered Product is unavailable and/or out of stock, the Client is informed and is also informed of the availability period of the sold-out Product by email or, in the case of an order for several Products, on the invoice of the shipped Products. HEDONIST LABS cannot in any case be held responsible for the unavailability of a Product. In the case of unavailability and/or out of stock of a Product(s), the Client may request, at his choice, a refund of the unavailable or out-of-stock Product, or a credit of the amount of the price of the unavailable or out-of-stock Product to be used for a subsequent order. Only the definitive stockout of a Product from HEDONIST LABS's suppliers leads to its removal from our product offering. HEDONIST LABS will then remove this Product from the Website as soon as possible.
HEDONIST LABS reserves the right to cancel or refuse any order from a Client with whom there is a dispute concerning the payment of a previous order.
Unless proven otherwise, the data recorded by HEDONIST LABS constitutes proof of all transactions conducted by HEDONIST LABS and its customers.
3. Offers and Prices
HEDONIST LABS reserves the right to modify its prices at any time but undertakes to apply the rates in force indicated at the time of the order, subject to availability on that date. The Offers and Products are provided at the rates in force appearing on the Website, at the time of recording the order.
The prices of the Products are indicated in euros, all taxes included, and do not include delivery charges, invoiced in addition, and indicated before validation of the order, packaging, and order processing.
Promotional offers are valid for the duration they mention and as long as they are displayed on the Website, as well as within the limits of available stocks. Orders can only be accepted if the prices mentioned are in conformity with those of the current offer.
The price is payable in full, in a single payment on the day of the order by the Client, by secure payment. At no time can the amounts paid be considered as earnest money or deposits. No cash on delivery will be accepted for any reason whatsoever. If one or more taxes or contributions, in particular environmental ones, were to be created or modified, upward or downward, this change could be reflected in the selling price of the Products.
All orders are invoiced in euros and payable in euros.
HEDONIST LABS reserves the right, in the event of non-compliance with the payment conditions, to suspend or cancel the delivery of current orders placed by the Client.
Delivery is constituted by the transfer to the Client of the physical possession or control of the Product.
4.1. PRODUCT AVAILABILITY FEES
For each order, a flat-rate contribution to availability costs is requested, which includes shipping costs, packaging, and order processing. The flat-rate contribution is indexed to the delivery method chosen by the Client at the time of placing the order.
The contribution to shipping costs is inclusive of VAT.
To reduce transport costs, all low or medium-sized products are shipped by Colissimo Suivi de La Poste, which commits to delivering within forty-eight (48) hours throughout France. It also allows the Client to pick up the ordered products at the nearest Post Office if they are not available at the initial delivery location when the postman attempts delivery. If the Client is absent on the day of delivery, the postman leaves a delivery notice in the mailbox, allowing the Client to retrieve the package at the Post Office within fifteen days. The Client can track the order using the Colissimo number sent by email on the day of shipment.
For availability reasons, an order may be delivered in several installments to the Client. The Client pays only one delivery fee in this case.
4.2. PRODUCT DELIVERY TIMES
HEDONIST LABS undertakes to make its best efforts to deliver the Products ordered by the Client as soon as possible. However, if the ordered Products have not been delivered within thirty (30) days after the order is placed, the Client must inform HEDONIST LABS promptly by phone or email. HEDONIST LABS will contact the carrier to initiate an investigation, which may last up to twenty-one (21) days. If the Products are found, they will be redirected to the Client's home. If the Products are not found at the end of the investigation, they will be deemed lost, and HEDONIST LABS can then resend replacement Products to the Client at no additional cost. If the ordered Products are no longer available, HEDONIST LABS will refund the amount of the lost Products. If the Products are still available but have changed their selling price on the website, HEDONIST LABS will apply the new prices, either by reimbursing the price difference by bank check or by requesting an additional bank check from the Client for the price difference.
In any case, if the Products have not been delivered within ten (10) days after the indicative delivery date, for any reason other than force majeure or the Client's fault, the sale may be terminated at the written request of the Client under the conditions provided for in Articles L. 216-2 to L. 216-4 of the Consumer Code. The amounts paid by the Client will then be refunded no later than fourteen days after the date of denunciation of the contract, excluding any compensation or withholding.
4.3. DELIVERY ADDRESS
The Products are delivered to the address indicated by the Client when placing the order. The Client must ensure its accuracy. Any package returned to HEDONIST LABS due to an incorrect or incomplete delivery address will be reshipped at the Client's expense, and HEDONIST LABS cannot be held responsible for the inability to deliver the order. If the Client wishes to be delivered to two different delivery addresses, he must place two separate orders, each with the corresponding delivery charges.
4.4. RECEIPT OF THE ORDER
Upon receipt of the order, the Client is required to check the condition of the delivered Products. In the case of apparent defects, the Client has the right of return under the conditions provided in these general terms and conditions. Any anomaly concerning the delivery (e.g., missing or damaged Products, damaged packages) must be indicated, first of all, on the delivery slip and in the form of handwritten reservations accompanied by the Client's signature with the carrier. Secondly, any anomaly must be notified to HEDONIST LABS as soon as possible following the receipt of the Products:

This verification is considered done as soon as the Client, or a person authorized by him, signs the delivery slip.
HEDONIST LABS reserves the right to ask the Client to return the damaged Product(s). In the case of abnormal or abusive returns, HEDONIST LABS reserves the right to refuse to honor any subsequent order from the Client.
If the Client notices at the time of delivery of his package to be handed over against a signature that it is damaged, he can, at his choice, refuse the package, which will then be directly returned to HEDONIST LABS, or accept the package while reporting the damage to its packaging.
If the Client finds that the packaging of his package to be delivered to the mailbox is damaged, he can, provided that the package has not been opened, refuse the package by returning it to the Post Office, no later than the working day following its distribution.
Returns under the "NPAI" reason correspond to packages returned by the carrier responsible for delivery with the mention: "Does Not Live at the Indicated Address." After receiving and accepting the package returned by HEDONIST LABS services, a credit for the total amount of the order, minus shipping costs, will be credited to the Client's account within forty-eight (48) hours following the receipt of the package by HEDONIST LABS. The Client can then place a new order, ensuring the accuracy of the delivery address provided. Returns under the "Unclaimed" reason
Returns under the "Unclaimed" reason correspond to packages that have not been claimed by Clients at the Post Office or at the merchant chosen by the Client when placing the order within fifteen (15) days from the notice of passage. After receiving and accepting the package returned by HEDONIST LABS services, a credit for the total amount of the order, minus shipping costs, will be credited to the Client's account within forty-eight (48) hours following the receipt of the package by HEDONIST LABS. The Client can then place a new order.
4.5. ORDERS DELIVERED OUTSIDE THE EUROPEAN UNION
Orders shipped to countries outside the European Union, including Switzerland and Norway, are expressed excluding taxes. Taxes are to be paid by the Client upon receipt of the package, according to the laws in force in the destination country. It is the Client's responsibility to inquire with local authorities about customs duties, local taxes, and other import duties that may be claimed, as these duties do not fall under HEDONIST LABS. The products marketed by HEDONIST LABS comply with French regulations. Therefore, it is up to the Client to inquire with the local authority of his country about possible importation and use restrictions on the ordered Products.
HEDONIST LABS cannot be held responsible for the purchase of a product considered non-compliant in a given country, whereas this product complies with French regulations.
5. Right of Withdrawal
In accordance with the provisions of Article L. 221-19 of the Consumer Code, the Client has a period of fourteen (14) days from the receipt of the order to exercise his right of withdrawal with HEDONIST LABS, without having to justify reasons or pay penalties, for a refund, provided that the Products are returned in their original packaging, complete and in perfect condition, allowing for resale.Damaged, already opened, soiled, or incomplete products will not be accepted for return. Products must be returned within fourteen (14) days of notifying HEDONIST LABS of the Customer's decision to withdraw. This period starts at the beginning of the first hour of the first day and ends at the expiration of the last hour of the last day of the period. If this period expires on a Saturday, Sunday, or a public holiday, it is extended until the first working day following. The product in its original packaging must be sent to the following address: HEDONIST LABS Customer Returns Service 10 Rue de la Paix 75011 Paris France The Customer must accompany the package with the withdrawal form below or any other unambiguous statement expressing the intention to withdraw: I hereby notify the withdrawal from the contract for the order of the Products below: – Order date: ………… – Order number: ………… – Customer name: …………………… – Customer address: ………………………… [Customer Signature] It is advisable to return the package by registered mail. In case it is lost during postal delivery, HEDONIST LABS cannot be held responsible.
6. RefundIn case of non-receipt of the order within the aforementioned delivery period, for any reason other than force majeure or the Customer's fault, the sale may be terminated at the written request of the Customer, under the conditions provided for in articles L. 216-2 of the Consumer Code. The amounts paid by the Customer will be refunded no later than fourteen (14) days following the date of termination of the contract by the Customer, excluding any compensation or withholding. In case of unavailability of the ordered Product, the Customer opting for a refund will be reimbursed within thirty (30) days of payment. If the right of withdrawal is exercised within the period specified in Article 5, only the price of the purchased Product(s) and the delivery costs are refunded; return costs are borne by the Customer. The Customer will be refunded within fourteen (14) days following the receipt of the Products by HEDONIST LABS. Regarding products labeled "preorder," a delivery date is indicated. The refund will be made according to the payment method used by the Customer when placing the order. HEDONIST LABS reserves the right to cancel and refund all orders placed by a professional.
7. Payment TermsThis is an order with an obligation to pay, which means that placing the order implies payment by the Customer. To pay the order, the Customer has the payment methods made available by HEDONIST LABS, namely payment by credit card (Shopify Payment) or the Paypal service. The Customer guarantees HEDONIST LABS that he has the necessary authorizations to use the chosen payment method when validating the order. HEDONIST LABS reserves the right to suspend any order management and delivery in case of refusal of payment authorization by the officially accredited organizations or in case of non-payment. HEDONIST LABS reserves the right to refuse delivery or to honor an order from a Customer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. HEDONIST LABS does not keep personal or financial information in its database during the Customer's payment processing.
PAYMENT BY CREDIT CARDPayment by credit card is made directly online through a secure transaction, with the Shopify Payments system. Payment data is exchanged in encrypted mode using the SSL 128-bit protocol (Secure Socket Layer). When the Customer orders on the website, the credit card is debited immediately according to the following terms: the Customer enters in the designated area, the number of his credit card without spaces between the digits, its expiration date, and the last three digits of the security code on the back of the card. The debit of the credit card is generally made at the time of shipment of the order. HEDONIST LABS also allows its Customers to print their order and transmit it to them by fax, remembering to include information about their credit card, or by mail.
8. Transfer of Ownership - Transfer of RisksThe transfer of ownership of HEDONIST LABS Products to the Customer will only take place after complete payment of the price by the Customer, regardless of the delivery date of the Products. Regardless of the date of transfer of ownership of the Products, the transfer of risks of loss and deterioration will only take place when the Customer physically takes possession of the Products. The Products, therefore, travel at the risk of HEDONIST LABS.
9. LiabilityThe Products sold on the website comply with the regulations in force in France. Products provided by HEDONIST LABS benefit automatically and without additional payment, regardless of the right of withdrawal: - from the legal conformity guarantee provided for in articles L. 217-4 and following of the Consumer Code, for apparently defective, damaged, or non-compliant Products; - from the legal guarantee against hidden defects provided for in articles 1641 and following of the Civil Code, resulting from a defect in material, design, or manufacturing affecting the delivered Products and making them unsuitable for use. Article L. 217-4 of the Consumer Code: "The seller delivers a good in conformity with the contract and is liable for defects of conformity existing at the time of delivery. It is also responsible for defects in conformity resulting from packaging, assembly instructions, or installation when it is responsible for them under the contract or has been carried out under its responsibility." Article L. 217-5 of the Consumer Code: "The good is in conformity with the contract: 1° If it is suitable for the usual expected use of a similar good and, if applicable: if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model; if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer, or his representative, particularly in advertising or labeling; 2° or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by him." Article L. 217-12 of the Consumer Code: "The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods." Article 1641 of the Civil Code: "The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it, or would have given it a lesser price, if he had known them." Article 1648 of the Civil Code: "The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect." To assert his rights, the Customer must inform HEDONIST LABS in writing of the non-conformity of the Products within a maximum period of two (2) years from the delivery of the Products or the discovery of hidden defects within a maximum period of two (2) years from their discovery. The Customer can choose between repairing or replacing the item, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code. Shipping costs will be refunded based on the invoiced rate, and return costs will be refunded upon presentation of supporting documents. Refunds for non-compliant or defective Products will be made as soon as possible and no later than thirty (30) days after HEDONIST LABS acknowledges the lack of conformity or hidden defect. The refund will be made by crediting the Customer's bank account or by bank check sent to the Customer. HEDONIST LABS' liability cannot be engaged in the following cases: - non-compliance with the legislation of the country to which the Products are delivered, which is the responsibility of the Customer to verify; - in the event of misuse, professional use, negligence, or lack of maintenance by the Customer, as well as in the event of normal wear and tear of the Product, accident, or force majeure. HEDONIST LABS' warranty is in any case limited to the replacement or refund of non-compliant or defective Products.
10. Intellectual PropertyAll trademarks, photographs, texts, comments, illustrations, images, animated or not, video sequences, sounds, as well as all computer applications that could be used on the website and more generally all elements reproduced or used on the site are protected by laws applicable to intellectual property. They are the full and entire property of HEDONIST LABS or its partners. Any reproduction, representation, use, or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of HEDONIST LABS, is strictly prohibited. The fact that HEDONIST LABS does not initiate proceedings upon becoming aware of these unauthorized uses does not constitute acceptance of such uses and waiver of prosecution. Any simple or hypertext link is strictly prohibited without express written consent from HEDONIST LABS.
11. Personal DataIn accordance with law no. 78-17 of January 6, 1978, relating to computers, files, and freedoms, it is recalled that the personal data requested from the Customer is necessary for the processing of his order and the establishment of invoices, in particular. This data may be communicated to HEDONIST LABS' potential partners responsible for the execution, processing, management, and payment of orders. HEDONIST LABS undertakes not to disclose to third parties the information provided by Customers and visitors to the website. These are confidential. They will only be used by HEDONIST LABS' internal services for order processing and to enhance and personalize communication, particularly through letters and informational emails, as well as in the context of personalizing the website based on users' observed preferences. The processing of information communicated through the website has been the subject of a declaration to the CNIL. The Customer has a permanent right of access, modification, rectification, and opposition regarding information concerning him. This right can be exercised under the conditions and according to the modalities defined on the website.
The Customer is informed that during their visits to the Website, a cookie may be automatically installed on their browsing software. The cookie is a data block that does not allow the identification of the Customer as a user but allows the recording of information regarding their navigation on the Website. To place an order on the Website, the Customer must accept cookies. The Customer can disable cookies, in which case they can access the Website but cannot place an order. Procedures for disabling cookies, depending on the Customer's browsing software, are available on the CNIL website http://www.cnil.fr.
12. Applicable Law – Dispute Resolution
These general terms of sale and the operations arising from them are governed and subject to French law. In the event of a dispute or claim, the buyer will first contact HEDONIST LABS to obtain an amicable solution.
All disputes to which the purchase and sale transactions concluded in accordance with these general terms of sale could give rise, concerning their validity, interpretation, execution, termination, consequences, and follow-up and which could not be resolved between the seller and the customer will be submitted to the competent courts under ordinary law.
The Customer is informed that, in any case, they can resort to conventional mediation, especially with the Commission de la médiation de la consommation, in accordance with Article L. 612-1 of the Consumer Code, or with existing sectoral mediation bodies, the references of which are provided below, or any alternative dispute resolution method (i.e., conciliation) in the event of a dispute.

13. Partial Non-validation
If one or more provisions of these general terms are deemed invalid or declared as such in application of a law, regulation, or following a definitive decision of a competent court, the other provisions will retain their full force and effect.
14. Force Majeure
Any circumstances beyond the control of the parties preventing the normal performance of their obligations are considered causes of exemption from the parties' obligations and result in their suspension.
The party invoking the above circumstances must immediately inform the other party of their occurrence, as well as their disappearance.
Will be considered as cases of force majeure all irresistible, external circumstances, unpredictable, inevitable, independent of the will of the parties, and which cannot be prevented by them, despite all reasonable efforts. Expressly considered as cases of force majeure or fortuitous events, in addition to those usually retained by the French courts and tribunals: the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning, the interruption of telecommunication networks, or difficulties specific to external telecommunication networks to Customers.
The parties will come together to examine the impact of the event and agree on the conditions under which the contract will be continued. If the force majeure event lasts for more than three (3) months, these general terms may be terminated by the injured party.
15. Pre-contractual Information – Customer Acceptance
The Customer acknowledges having been provided, prior to placing their order, in a readable and understandable manner, with these General Conditions and all the information and details referred to in Articles L. 111-1 to L. 111-8 of the Consumer Code, and in particular:
the essential characteristics of the Product, taking into account the communication medium used and the Product concerned; the price of the Product and its ancillary costs; in the absence of immediate execution of the contract, the date or deadline by which HEDONIST LABS undertakes to deliver the Product;
information regarding the identity of HEDONIST LABS, its postal, telephone, and electronic contact details, and its activities, as long as they do not emerge from the context;
information regarding legal guarantees and their implementation methods;
the features of digital content and, where applicable, its interoperability;
the possibility of resorting to conventional mediation in the event of a dispute; information regarding the right of withdrawal.
The act of ordering on the Website entails full and complete acceptance of these general terms of sale and the obligation to pay for the ordered Products, which is expressly recognized by the Customer, who waives, in particular, the right to rely on any contradictory document, which would be unenforceable against HEDONIST LABS.
